1. Gigeshare's Service.
Gigeshare is a file hosting service. A file hosting service is where a user uploads a file to use it as a backup, transfer, or for sharing. Our service are availble for anyone to use that doesn't violate any legal rights. By using our service you agree to this agreement, out terms of service. The user must be able to legally bind to a agreement to be able to use our service. By using our service we cannot guaranteed that the file hosted on our servers in any way.
2. Gigeshare's Website.
All content on this website, except for the uploads by it's users are provided by Gigeshare and are copyrightted to Gigeshare. You cannot use it for your own purposes without first asking Gigeshare for permission.
3. User Uploads.
Any uploads by the users are owned by the user. You agree, if a legal problem occur with your upload that you will bear all the legal actions with your uploaded files. Gigeshare does not allow the uploads of copyrightted materials, harmful materials and materials that are not legal in our or your countries. If you upload any of these materials you hold full responsibilities to them. The files uploaded are stored on Gigeshare servers for as long as they are accessed, unless they violate our Terms of Service. Only the User uploaded the file and Gigeshare have the permisson to delete the file. If your upload violate the Terms of Service we will delete your file and report you to the necessary authority. All the files uploaded by the users are not guaranteed in any way. Gigeshare will try it's best to keep the file in the best condition, but we do not hold responible if the file is damaged, or any defects.
4. User Account and Password
Any information reguarding to your account and password are yours to maintain, remember and to keep secure. We do not hold any responsiblities if your account is hacked or is deleted. You hold full responsibilities for you account and for what you do with it.
5. Indemnity
You agree to defend, indemnify, and hold harmless Gigeshare, its affiliates, officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal fees, alleging or resulting from your use the Service, or your breach of this Agreement or other Gigeshare policies, terms and conditions.
6. Acceptable Use
You agree to not use Gigeshare's Service to:
a. upload, post, e-mail, transmit or otherwise make available any Content that spreads messages of terror or depicts torture or death-gui; if serious enough, the content will be reported to the appropriate legal authority and/or the member's ISP will be contacted;
b. harm minors in any way, this includes any form of child pornography; if serious enough, the content will be reported to the appropriate legal authority and/or the member's ISP will be contacted;
c. upload, post, e-mail, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
d. Gigeshare neither sanctions nor permits site content or the transmission of data that contains illegal or obscene material or fosters or promotes illegal activity, including but not limited to, gambling, the offering for sale of illegal weapons, and the promotion or publication of any material that may violate hate crimes legislation.
e. Gigeshare reserves the right to immediately suspend or terminate any account or transmission that violates this policy, without prior notice.
Further, if the Customer violate this policy, Gigeshare will actively assist and cooperate with law enforcement agencies and government authorities in collecting and tendering information about Customer, Customer's site, the illegal or obscene content, and those persons that may have inappropriately accessed, acquired, or used the illegal or obscene content.
7. Termination
Gigeshare hold the right to terminate your use of our service for any reason.
8. Others
By using our service, You, the user agree, that we may remove your files/terminate your account at any time. You agree that Gigeshare does not have to supply any information why your file is removed our why your account was terminated.
9. Our Rights
Gigeshare reserve the right to change this Service Agreement at any time without notice. We also reserve the right at any time to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that we shall not be liable to you or any third party for any modification, suspension or discontinuance of the Service.

9/20/07: Gigeshare's Merge.
We have a great announcement to make. Gigeshare is planning to merge it's services with YaStorage.com. This merge will greatly increase our capabilities to
provide a much better service to all of our users.
In the next couple of days you may experience problem downloading. This is due to the fact that we are transfering data necessary to make our merge
complete.
As many of you may know there have been many issues with Gigeshare lately, and we beleive that this merge shall fix it all.

Share the download link with your friends and family or just keep it for yourself to use it as a backup. If you want to delete the file use the delete link. No one except you and gigeshare.com can delete your file. If you have entered a email address you will also recieve these information. The reciepient email will also receive all the same information except the delete link.
